Medical Negligence
On January 27, 2007, Mr. Bodner was invited by Hospital for Special Surgery, one of New York's premier orthopedic hospitals, to instruct its senior residents and fellows concluding their training about how to ensure patient safety and limit being sued for medical negligence.
Hospital for Special Surgery asked Mr. Bodner to give his perspective as a patients' advocate and plaintiff's attorney. He was part of a faculty which included practicing orthopedic surgeons and a director of the American Academy of Orthopedic Surgeons. Mr. Bodner's lecture emphasized developing and maintaining a trusting and attentive physician/patient relationship, both before, during, and after performance of surgery.
In addition, Mr. Bodner spoke about a 2006 study which reviewed medical negligence lawsuits over a 15-year period. This study demonstrated how very few physicians have ever made a payment in such a lawsuit. Specifically, from 1990 to 2005, 5.9% of all practicing physicians were responsible for 57.8% of all medical negligence payments. Based on government statistics, the study found that each of these doctors made at least two payments, while 82% of physicians had never made one payment. The study also demonstrated that almost all of these payments were for very serious injuries, including a very large percentage for wrongful death.
